General Conditions of Sale

If you wish to make a reservation, we will send you the T&Cs adapted to your reservation, to validate, sign and date.

1. Purpose
The purpose of this document is to define and set the general conditions of the rental.

2. Designation of accommodation
  • Kauli Villa of 190 m² including 40 m² of terrace with garden view. Includes 3 bedrooms, 1 bathroom, 1 shower room, 3 toilets, a large living room and an open equipped kitchen. Maximum capacity: 6 people*.
  • Studio Miti of 55 m² including 27 m² of terrace. Open equipped kitchen, sleeping area, bathroom with walk-in shower, mezzanine. The studio opens onto a private terrace with sofa and dining area with high table and chairs. Maximum capacity: 3 people*.
  • Studio Vai of 65 m² including 18 m² of terrace. Equipped closed kitchen, lounge area, sleeping area, bathroom with walk-in shower. The studio opens onto a private terrace with sofa and dining area with high table and chairs. Maximum capacity: 2 adults and 1 child*.
(*) Children accepted from 7 years old.

In the Miti and Vai studios the rate per night is based on 2 people. Additional adult: 7.000 XPF / night. Additional child: 5.000 XPF / night.

The chosen property is only rented for furnished tourist accommodation. Any commercial or private event involving, for example, the invitation of additional people is strictly prohibited.

3. Duration of the seasonal rental / Arrival & Departure
  • Arrival is between 2:00 p.m. and 5:00 p.m.; departure is no later than 10:00 a.m.
  • Early check in (if available): 5.500 XPF
  • Late check out (if available): 5.500 XPF
  • The usual formalities (inventory, inventory, credit card deposit, key collection) will take place when taking the accommodation and when leaving.

4. Rental prices and charges
  • To obtain the rental amount agreed, please refer to your reservation.
  • This price includes bed and bath linen, electricity and water consumption, internet access, cleaning before your arrival.
  • Toiletries, cleaning products and food are not included.
  • In the event of a long stay, a washing machine is at your disposal (excluding products). The Green Villa can also offer you a cleaning service during your stay (cleaning + changing towels) at the rate of 5.000 XPF per cleaning for studios and 8.500 XPF per cleaning for the Kauli Villa.
  • At the end of your stay, a flat rate of 5.000 XPF for the studios and 8.500 XPF for the Kauli Villa will be charged for the cleaning service.
  • In addition, a tourist tax (60 XPF/day/pers) will be charged.

5. Reservation
  • The reservation becomes effective once the Tenant has paid the full amount (100%) of the accommodation price and validated these general terms and conditions of sale. Otherwise, the reservation will be automatically cancelled.

6. Security deposit
  • At the latest upon entering the premises, the Tenant will give the Lessor an amount of 50.000 XPF for each studio and 100.000 XPF for the Kauli Villa, as a security deposit which will be made by bank loan (credit card, visa, MasterCard by bank pre-authorization) or in cash.
  • A copy of the passports/identity documents of any person residing at the Green Villa (including children) will be made at check-in. A valid bank card (visa, MasterCard) is also required (N26, Revolut, Amex cards, etc. are not accepted as a deposit).
  • The security deposit will be returned to the Tenant within a maximum of one month after departure, after deduction, where applicable, of the amounts covering damage and/or deterioration of the accommodation and the furniture and objects furnishing the accommodation, caused by the Tenant, as well as loss of keys or objects.

7. Assignment and subletting
  • The rental contract is concluded for the sole benefit of the Lessee identified at the time of booking and for the destination mentioned in § 2.
  • Any assignment of this lease, any total or partial subletting, any provision (even free of charge), are prohibited. The Lessee may not leave the premises at the disposal, even free of charge and/or by loan, to another person, and remains solely responsible for the execution of the reservation contract.

8. Inventories and inventory
  • Arrival at the accommodation
    • The inventory and instructions relating to the accommodation are given to the Tenant upon entry into the accommodation.
    • The inventory must be drawn up and signed simultaneously by Green Villa or its representative and the Tenant.
  • Departure from the accommodation
    • The inventory at the end of the contract will be drawn up and signed simultaneously by Green Villa or its representative and the Tenant.
    • The Tenant's presence is mandatory.

9. Obligations of the Green Villa
  • The Green Villa delivers to the Tenant the accommodation in good condition of use with its parking space: uncovered parking immediately to the right for the Kauli Villa and covered parking of 2 spaces at the back to the left for the studios.
  • The Green Villa will give the Tenant all the information necessary for access to the property or the beach (automatic gate code, keys, etc.).
  • The Green Villa assures the Tenant the peaceful enjoyment of the accommodation, and cannot be held responsible for hidden defects and faults.
  • The Green Villa maintains the premises according to the intended use, and makes all necessary repairs other than rental repairs.
  • The Green Villa is not responsible for personal items left in the property, during or after the stay, and cannot be held responsible for any damage, bodily injury, loss or costs inherent directly or indirectly to events beyond its control.
  • La Green Villa provides a safe in each accommodation and disclaims all liability in the event of theft of cash or personal effects of the Tenant.

10. Obligations of the tenant
  • The Tenant agrees to occupy the property only for private purposes during his stay. Under no circumstances may he use it for a commercial, craft or professional activity.
  • The Green Villa may only be occupied by the people listed on the reservation. Failure to comply with this clause will result in a penalty of 7.000 XPF per person and per additional day and will result in the immediate cancellation of the reservation contract, with no possible refund.
  • Any inaccuracy concerning the occupants (number, age, etc.) will result in a penalty of 7.000 XPF per person and per day.
  • The Lessee may not object to the visit of the premises if Green Villa or its agent so requests.
  • The Lessee shall peacefully use the rented accommodation, furniture and equipment, and shall be liable for any damage or loss that may occur during the term of the contract in the premises of which he has exclusive use. If items listed in the inventory are broken or damaged, Green Villa may claim from the Lessee their replacement value at the price of the day.
  • The Lessee shall avoid any noise likely to disturb the neighborhood (no parties, etc.).
  • The Lessee shall occupy the premises under his sole responsibility; any negligence resulting in bodily injury or material damage to persons present during the rental shall not incur the liability of the Green Villa.
  • Animals are not accepted.
  • Minors are under the full responsibility of their parents, legal representatives or accompanying adults.
  • The Tenant is required to return the premises in a good state of cleanliness; if this is not the case, the Tenant undertakes to take charge of any additional cleaning that the Green Villa would be required to carry out. In any event, even if a cleaning service is charged in addition to the rental price, the Lessee must clean and put away the dishes, empty the trash, put the furniture and objects back in place, and put the household linen provided in the spaces provided for this purpose.
  • In the event of indelible stains or deterioration of the household linen (sheets, pillowcases, blankets, mattress protectors, mattress pads, pillows and bath towels, etc.), the Lessee will be subject to an additional charge of 8,000 XPF. In the event that the linen cannot be recovered, the new value of the linen to be replaced will be billed to the Lessee.
  • Smoking is strictly prohibited inside the accommodation; failure to comply with this clause will result in a penalty of 50.000 XPF in case of smell of tobacco inside the accommodation.
  • It is forbidden to have barbecues and fires in the grounds of the Green Villa, as well as around the beach.
  • The use of garden hoses to clean cars, scooters (...) is forbidden.
  • The Tenant may not exercise any recourse against the Green Villa in the event of theft and damage to the rented premises.

11. Cancellation / Modification / Termination
  • Cancellation by the Tenant
    • Cancellation more than 45 days before the arrival date: reimbursement of the amounts paid less 5.000 XPF of administration fees.
    • Cancellation between 44 and 31 days before the arrival date: 50% of the price of the stay will be due.
    • Cancellation between 15 and 30 days before the arrival date: 75% of the price of the stay will be due.
    • Cancellation less than 14 days before the arrival date: 100% of the price of the stay will be due.
    • If the Tenant decides to shorten his stay, the total price (100%) of the rental remains acquired by Green Villa for whatever reason.
    • Upon receipt of the cancellation request, the rental will be deemed terminated automatically, and Green Villa will be able to dispose of the property initially rented.
    • The Tenant will not may only leave after having checked out in the presence of a Green Villa representative.
  • Cancellation by Green Villa
    • In the event that unforeseen circumstances render the property inaccessible (fire, damage), Green Villa undertakes to reimburse 100% of the sums paid excluding bank charges and cannot be the subject of a claim for compensation.
  • Modification
    • Any change of dates will result in a penalty of 5.000 XPF (modification of dates according to our availability).
  • No-Show (termination by operation of law)
    • In the event of a "No-show" (non-presentation of the Tenant on the scheduled day of entry, or absence of notification of late arrival) this contract will be terminated by operation of law and the Green Villa will be able to dispose of the rented property.
    • 100% of the price of the stay will be due.

12. Dispute resolution
  • In the event of a dispute over these T&Cs, or for any dispute, only the courts of French Polynesia will have jurisdiction.

13. Disclaimer
  • The Lessee accepts the clauses of these T&Cs and declares to release the Green Villa from all liability in the event of an accident of any nature whatsoever, or damage, without any exception or reservation, caused by and to his person and his companions, others, animals, vehicles and generally any object and/or property whatsoever borrowed or made available to us in the rented premises, but also during the practice of an activity or excursion booked on his behalf by the Green Villa.
  • The Lessee declares to be aware of the risks and dangers inherent in the use of any outdoor nautical and land equipment that would be made available to him in the rented property.
  • Aware of the risks, the Lessee accepts them in full knowledge of the facts, and declares to waive any recourse, prosecution or claim against the Green Villa, represented by its managers.
  • The Lessee declares, on the other hand, release Green Villa from any liability in the event of non-compliance with the legislation in force concerning noise pollution in the rented properties.
